Terms and Conditions
- These terms and conditions govern participation in a free-of-charge prize promotion (hereinafter the “Promotion”) and the rights and obligations arising therefrom between you and Philip Morris Austria GmbH, Vorgartenstraße 206 B–C, 1020 Vienna (hereinafter “PMAT”).
- The Promotion is limited in time and includes a participation period from 8 June 2026 (00:01 a.m.) to 31 July 2026 (11:59 p.m.).
- Participation is exclusively open to adult nicotine users (having reached the age of 18), who qualify as consumers and have their place of residence in Austria (hereinafter the “Eligible Participants”). Any subsequent loss of consumer status or Austrian residence shall result in retroactive exclusion from the Promotion and the corresponding loss of any rights or legal relationship arising from participation. Persons who are professionally or in a comparable manner involved in the sale, distribution, other provision, or recommendation of products manufactured or distributed by PMAT in any form whatsoever are not eligible to participate.
- Participation takes place through the explicit declaration of the Eligible Participant within the participation period via the platform(s) designated by PMAT for this purpose, by which the Eligible Participant simultaneously accepts these terms and conditions as well as all other promotion-related rules defined by PMAT and provides all information required for participation. Mere awareness of the Promotion and its terms without an explicit declaration linked thereto shall not suffice.
- By participating in the Promotion, Eligible Participants have the opportunity to win 1 of 50 Wunsch vouchers with a value of EUR 20 as an instant prize or 1 of 3 AirPods Max.
- Eligible Participants may participate only once in the Promotion and may receive no more than one prize. In the event of repeated participation, participants may be excluded from receiving a prize; however, PMAT is not obliged to do so. Cash payment or any other substitution of prizes (in particular cash or non-cash alternatives), exchange, or transfer to other persons is excluded.
- The determination of the winners for the respective prizes and notification of the winning Eligible Participants shall be carried out by PMAT within a reasonable period after the end of the participation period. A period of one month shall in any case be deemed reasonable, although a shorter period may be required in individual cases. Eligible Participants must confirm acceptance of any prize within ten days of notification, otherwise the prize shall lapse. PMAT is entitled, but not obliged, (i) to define a longer confirmation period in individual cases, (ii) to waive the consequences of forfeiture in the event of late confirmation, and, after expiry of the confirmation period, (iii) to allocate prizes to other Eligible Participants or third parties or to leave them unused entirely. Winners will be notified via the e-mail address or telephone number provided at the time of participation. PMAT reserves the right to make the delivery of the prize conditional upon prior presentation of an official identification document (if applicable, in copy form) for the purpose of verifying legal age at the time specified in Section 3.
- Eligible Participants undertake not to disseminate any content (including texts, images, videos, etc.), via social media or hashtags, relating to (i) PMAT and companies affiliated with PMAT, (ii) their products and brands, (iii) this Promotion and any prizes connected therewith, or (iv) other activities or communications of PMAT or companies affiliated with PMAT.
- Where legitimate interests are affected, in particular in cases of suspected abuse or conduct contrary to the intended purpose, PMAT is entitled to exclude Eligible Participants, in whole or in part, permanently or temporarily, from participation opportunities in connection with this or other promotions. PMAT does not provide any advice, representation, or other services in connection with taxes or duties of any kind.
- The rights of Eligible Participants in the event of defects in quality or title and any liability of PMAT shall be governed by the statutory provisions, unless otherwise provided below. In the event of breaches of duty – irrespective of the legal basis – PMAT shall be liable for intent and gross negligence. In cases of slight negligence, PMAT shall only be liable (i) for damages resulting from injury to life, body, or health and (ii) for damages resulting from the breach of a material contractual obligation (an obligation the fulfillment of which is essential for the proper execution of the contract and on the observance of which the contractual partner regularly relies and may rely); in this case, liability shall be limited to compensation for foreseeable damages typically occurring. The above limitations of liability shall also apply in the event of breaches of duty by persons whose fault PMAT is liable for under statutory provisions.
- The Promotion may be amended, restricted, or terminated by PMAT at any time with regard to its subject matter, personal scope, time, or geographical applicability, insofar as this is required or may appear required due to legal or special factual reasons occurring or becoming known after the start of the participation period.
- Austrian law shall apply to the Promotion and all rights and obligations arising in connection therewith, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG) and conflict-of-law rules. The courts having subject-matter jurisdiction in Vienna, Inner City, shall have exclusive jurisdiction.
